December 03, 1993

United States Fidelity & Guaranty Co., U.S. District Court, Eastern District of Washington, Case No. CS-93-0194-AAM (E.D.W.A., Dec. 3, 1993).  The court found that the complaint that briefly alleged infringement and inducement without specifying pertinent conduct where the request for injunctive relief including Hullpak's advertising activities. Evidenced a causal nexus to advertising. The court reasoned "that Hullpak infringed on patents by: "issue, participating in trade shows at which Hullpak generated leads for sales and solicited parties at the trade show for sales, and engaging in price cutting competition." The court finds that these activities comprise "advertising."
