Deutsche Wurlitzer GmbH dba The Wurlitzer Jukebox Company filed a suit for insurance coverage benefits against Milwaukee Mutual Insurance Co. in U.S.D.C., N.D. Ill., Case No. 04-C-3312. The underlying action was Baldwin Piano, Inc. v. Deutsche Wurlitzer GmbH The Wurlitzer Jukebox Company, U.S.D.C., N.D. Ill., Case No. 03-C-2105. Milwaukee was required to reimburse, at full reasonable rates, counsel for Wurlitzer - Pattishall, McAuliffe, Newbury, Hilliard & Geraldson, LLP in Chicago - and to contribute to settlement of the underlying dispute under coverage for trademark infringement claims within the "advertising injury" provisions for the "use of another's advertising idea in your ‘advertisement.' "
