Simba Toys filed a coverage action against Travelers Indemnity Co. and Travelers Indemnity Co. of America in U.S.D.C., C.D. Cal., underlying Case No. CV03-9388 MNM (CWx). Following litigation, Travelers recognized its duty to defend and settle. There were allegations of trade dress and trademark infringement as well as copyright infringement that fell within the pertinent "advertising injury" offenses of "infringement of copyright" and "misappropriation of style of doing business," as well as "misappropriation of advertising ideas." Travelers was obligated to pay the full reasonable rate of defense counsel Knobbe, Martens, Olson & Bear.
