In a coverage action filed against Sumitomo Marine & Fire Insurance Co., Ltd., which was subsequently transferred to the Eastern District of Pennsylvania, where Nichia America Corporation maintained its principal place of business, the parties settled, with Sumitomo agreeing to pay $2 million for patent infringement claims in lieu of defense fees, where its 1976 ISO policy form included express "advertising injury" coverage for "piracy." The underlying actions included a case pending in the United States District Court for the Eastern District of North Carolina, styled as North Carolina State University and Cree, Inc. v. Nichia Corporation and Nichia America Corporation, Civil Action No. 5:00-CV-703F(2), as well as Rohm Co., Ltd. v. Nichia Corporation and Nichia America Corporation, Civil Action No. 00-CV-6379, also pending in the Eastern District of Pennsylvania.
