Konami (America), Inc. v. Hartford Insurance Co., Illinois Court of Appeal, Second Judicial District, Case No. 001219; trial court action DuPage County, Ill., 18th Judicial District, Case No. 94L00982. In the underlying action, North American Phillips Corporation v. American Vending Sales, Inc., U.S.D.C., N.D. Ill., Case No. 93C326. Mark Halligan of Walsh & Katz Ltd. served as coverage counsel. The trial court reached a favorable conclusion on the duty to defend, which was affirmed in part by the court of appeal, which found "piracy" could encompass patent infringement. The appellate court found insufficient evidence of a nexus to advertising because a gaming machine operating in "attractive" mode was not "advertising" for the benefit of trade show attendees who were interested in procuring gaming equipment for retail use.
