Fonovisa pursued various claims for trademark and copyright infringement and unfair competition against various artists affiliated with Banda Maguey in an action pending in U.S.D.C., C.D. Cal., as well as various claims for copyright infringement against individuals engaged in acts of piracy. In a series of enforcement suits brought against pirates, litigation costs were deferred by the settlements obtained from insurers (where they existed) for some defendants sued by Fonovisa. In a seminal Ninth Circuit action in which Gauntlett & Associates attorneys participated, which made news, the court found that a contributory infringement lawsuit arose against a swap meet owner for failing to police music sellers whom it knew were engaging in infringing conduct.
