G&A won a $28.4 million judgment for Hewlett-Packard Company from ACE Property & Casualty Insurance Co. on August 22, 2007, representing an award of defense costs in an underlying antitrust case. (Hewlett-Packard v. ACE, U.S.D.C., N.D. Cal.) In December 2007 the district court took under submission HP's request for quantification of another $23 million in pre-judgment interest and costs. ACE had refused to defend antitrust counterclaims in a patent and trademark infringement lawsuit even though the claims expressly raised the covered "advertising injury" offense of unfair competition. G&A established that HP was entitled to insurer payment for all post-tender litigation expenses, including those proving that the opposing party had infringed HP's patents and trademarks, because all of the expenses were reasonable and necessary for the defense of wide-ranging antitrust claims.
