James A. Lowe, Partner
With over 43 years of legal experience, James A. Lowe has built a distinguished career as a trial lawyer in Colorado and California, representing individuals, small businesses, and Fortune 500 companies. His practice focuses on intellectual property and complex litigation, handling high-stakes cases across the United States. Throughout his career, Mr. Lowe has appeared in courts across 25 different states, advocating for clients in a broad range of disputes.

Has conducted hundreds of jury and bench trials over more than four decades including numerous copyright, trademark, patent, trade secret and insurance coverage trials.
Served as a U.S. Air Force Judge Advocate on active duty and in the reserves for 24 years (1971-1995), Lt. Colonel, retired.
Served as Chief Deputy District Attorney in the 10th Judicial District of Colorado (1975-1981).
Practice emphasis is intellectual property litigation (copyright, trademark, patent, etc.) and insurance coverage for intellectual property defense.

Jodi D. Spencer, Sr. Assoc.
For two decades Jodi D. Spencer Johnson has devoted her practice to representing individual and corporate policyholders in insurance coverage actions both regionally and across the nation. She has advised and represented policyholders on a wide range of first and third party liability claims, including complex, multi-insurer environmental and toxic tort coverage claims, construction, D&O, crime, employment practices liability and intellectual property claims.

Jodi also has significant experience in asserting bad faith claims, and was part of a team that secured punitive damages in a jury trial on bad faith claims handling. She is an Ohio State Bar Board Certified Insurance Coverage Specialist, and frequently presents and authors publications concerning various coverage issues for local, state and national bar associations including the ABA Section of Litigation Insurance Coverage Litigation Committee where she has served in various leadership roles for the last decade.

Nick F. Owen, Associate
Nick Owen joined Gauntlett & Associates in 2021 after being admitted to the California Bar, focusing on insurance coverage and commercial litigation. He earned his J.D. from the University of Florida Levin College of Law and his B.A. from the University of Florida. Nick gained legal writing and litigation experience through a summer internship with the Honorable Gary R. Jones from the Northern District of Florida, where he drafted court orders, summary judgments, and agency reviews.

The cases involved both federal and state law and covered topics ranging from Medicare reimbursements to assault and battery. He also assisted the clerk with research to streamline her own projects.
Nick was also an editor for the Princeton Review in New York City, New York where he wrote mock questions for several standardized test review books. One particular aspect of his job function was updating several physics books to better reflect changes to their corresponding AP tests, and proofreading them for errors in both grammar and content. He worked independently on his own tasks and reviewed the work of others to ensure quality throughout the projects.
Mr. Owen has also been a Classroom Teacher and Private Tutor. He taught classes ranging in size from a handful to over a hundred students. He participated in several chartered programs for teaching in public and private schools and adapted the lessons to balance the needs of high- and low-scoring students in the same class. As a Tutor he worked one-on-one with students of virtually all backgrounds to improve performance on standardized tests ranging from specialized high school admissions tests to the MCAT and LSAT. He also created individualized lesson plans to best suit the needs and demeanor of each student.

Erica J. Barseghian, Associate
Erica Barseghian is a First-Year Associate at Gauntlett & Associates, focusing on intellectual property and insurance coverage litigation. She earned her B.S. in Applied Mathematics from UCLA in 2020 and her J.D. from Loyola Law School, graduating with Honors in the Intellectual Property Concentration. She has experience in litigation strategy, contract disputes, and insurance law, working on trademark, copyright, and commercial liability cases.

At Loyola, she served on the Board of Editors for Loyola of Los Angeles International and Comparative Law Review as Senior Production Editor and was an active member of the Women’s Law Association and the Armenian Law Students’ Association. Erica also assisted in research to issues regarding deep fakes and the Opioid crisis.

David A. Gauntlett, Principal
David A. Gauntlett is the principal of Gauntlett Law. He earned his J.D. from the University of California at Berkeley’s Boalt Hall School of Law in 1979, where he served on the California Law Review. He received his B.A., Magna Cum Laude, from the University of California at Irvine in 1976.
Mr. Gauntlett serves as lead counsel in intellectual property and antitrust insurance coverage disputes pending in more than 30 states. He is recognized for his work in precedent-setting coverage litigation involving patent, trademark, and copyright infringement, as well as trade secret misappropriation and unfair competition claims. He is admitted to practice before the U.S. Supreme Court, the Federal Circuit, eleven U.S. Courts of Appeal, and 24 U.S. District Courts—including all federal districts in California, Florida, Illinois, New York, and Wisconsin.
